Ontario Pool, Spa & Waterpark Safety Sign Requirements — Public Health

Every public pool, spa, hot tub, splash pad, and waterpark in Ontario must comply with signage requirements under O. Reg. 565 (Public Pools) made under the Health Protection and Promotion Act, R.S.O. 1990, c. H.7. Local public health units conduct regular inspections, and non-compliant facilities face closure orders, fines, and mandatory corrective action. Who Must Comply

Under O. Reg. 565, Section 1, the regulation applies to:

  • Class A pools: Public pools operated by municipalities, hotels, motels, condominiums, apartment buildings, or any entity where the public or residents have access
  • Class B pools: Pools at clubs, schools, and facilities with restricted membership
  • Whirlpools/hot tubs: All public whirlpools and hot tubs
  • Wading pools: Including splash pads and spray pads
  • Waterparks: All water slides, wave pools, lazy rivers, and interactive water features open to the public

Private residential pools serving only the homeowner's family are not covered by O. Reg. 565, but are subject to municipal fencing by-laws under the Municipal Act, 2001.

Required Pool Safety Signs

1. Pool Rules Sign (O. Reg. 565, Section 16)

  • Content must include:
  • "No person with a communicable disease or open wound shall use this pool"
  • "All bathers must shower before entering the pool"
  • "No glass containers in the pool area"
  • "No running on the pool deck"
  • "Children under [age] must be accompanied by an adult" (age set by the operator, typically 10-12)
  • "No diving in shallow water" (where water depth is less than 1.5 metres)
  • "Persons using the pool do so at their own risk" (where no lifeguard is on duty)
  • Posting: Prominently displayed at the entrance to the pool area and visible from the pool deck
  • Size: Large enough to be read from the pool entrance — minimum 600 mm x 900 mm recommended

2. Water Depth Signs (O. Reg. 565, Section 15)

  • Required markings: Water depth in metres (not feet) at the shallow end, deep end, and at each break in the pool floor slope
  • Method: Displayed on the pool deck edge AND on the pool wall at or above the water line
  • Character height: Minimum 100 mm (4 inches) — clearly visible from the pool deck
  • Colour contrast: Dark characters on a light background or light characters on a dark background
  • "NO DIVING" markings: Required at any point where the water depth is less than 1.5 metres
  • Slope transition: A contrasting line or marking on the pool floor where the bottom slope changes

3. Emergency Equipment Signs

  • Emergency telephone sign: "EMERGENCY — CALL 911" posted at the emergency telephone location
  • First aid kit location: "FIRST AID" sign posted at the first aid kit with directional arrows if not immediately visible
  • Life-saving equipment: Ring buoys and reaching poles must be stored on clearly marked hooks/brackets with "LIFE SAVING EQUIPMENT — DO NOT REMOVE" signs
  • AED location: Where an Automated External Defibrillator is available, the universal AED symbol and location sign must be posted
  • Spinal board: Location sign required where a spinal board is available

4. Capacity Sign

  • Maximum bather load: Must be posted at the pool entrance — calculated based on pool surface area (O. Reg. 565, Section 8: 2.2 m² per bather for pools, 0.9 m² per bather for wave pools)
  • Hot tubs/whirlpools: Maximum number of users posted adjacent to the hot tub (typically based on seating capacity)

5. Lifeguard Status Sign

  • "LIFEGUARD ON DUTY" or "NO LIFEGUARD ON DUTY — SWIM AT YOUR OWN RISK"
  • Must accurately reflect the current status — changing the sign when lifeguard shifts begin and end
  • When no lifeguard is on duty, additional signs must warn of the increased risk

6. Chemical Hazard Signs (Pool Equipment Room)

  • WHMIS/GHS labels on all chemical containers (chlorine, muriatic acid, pH adjusters)
  • "DANGER — POOL CHEMICALS — AUTHORIZED PERSONNEL ONLY" on the equipment room door
  • Safety Data Sheets must be accessible in or near the equipment room
  • Ventilation warning: "VENTILATION REQUIRED — DO NOT BLOCK VENTS" in chemical storage areas
  • Mixing warnings: "DANGER — NEVER MIX POOL CHEMICALS" posted near chemical storage

Hot Tub / Whirlpool Specific Signs

  • Maximum time: "RECOMMENDED MAXIMUM SOAK TIME: 15 MINUTES"
  • Temperature warning: "WATER TEMPERATURE EXCEEDS 40°C — LIMIT YOUR TIME"
  • Health warnings: "PERSONS WITH HEART CONDITIONS, HIGH BLOOD PRESSURE, OR WHO ARE PREGNANT SHOULD CONSULT A PHYSICIAN BEFORE USE"
  • Alcohol warning: "DO NOT USE HOT TUB WHILE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS"
  • Children: "CHILDREN UNDER [AGE] MUST BE ACCOMPANIED BY AN ADULT"
  • Temperature display: Current water temperature must be displayed or available to users

Waterpark and Water Slide Signs

  • Rider requirements: Height, weight, and age restrictions posted at each slide entrance
  • Riding instructions: "FEET FIRST ONLY", "ONE RIDER AT A TIME", "WAIT FOR GREEN LIGHT"
  • Health warnings: "DO NOT RIDE IF PREGNANT, HAVE BACK/NECK PROBLEMS, OR HEART CONDITIONS"
  • Queue line safety: "NO RUNNING" and crowd management signs
  • Wave pool: Depth markers, non-swimmer area boundaries, and warning signs about wave intensity

Public Health Inspection and Enforcement

Local public health units enforce O. Reg. 565:

  • Inspection frequency: Minimum twice per year for Class A pools, once per year for Class B
  • Unannounced: Inspections are unannounced — inspectors can enter at any time the facility is open
  • Signage review: Missing, damaged, or non-compliant signs are cited in inspection reports
  • Compliance orders: Written orders requiring corrective action within a specified timeline
  • Closure orders: Pools can be ordered closed immediately for serious deficiencies including missing safety signs
  • Fines: Up to $5,000 per day under the Health Protection and Promotion Act for non-compliance with closure or compliance orders
  • Public disclosure: Pool inspection results are published online by most public health units — the Niagara Region Public Health posts all results
