Ontario Liquor Licence Signage Requirements — AGCO Compliance Guide
Every establishment holding a liquor licence or liquor sales licence in Ontario must comply with signage requirements set by the Alcohol and Gaming Commission of Ontario (AGCO) under the Liquor Licence and Control Act, 2019, S.O. 2019, c. 15, Sched. 22 and O. Reg. 746/21. Non-compliance can result in licence suspension, monetary penalties up to $250,000, or permanent licence revocation. Whether you operate a restaurant, bar, brewery taproom, winery retail store, or convenience store with a liquor sales licence, your signage must meet AGCO standards.

Who Needs AGCO-Compliant Signage?
Under the Liquor Licence and Control Act, 2019, the following licence holders must comply with AGCO signage requirements:
- Liquor licence holders: Restaurants, bars, nightclubs, hotels, caterers, ferries, trains, aircraft
- Manufacturer's licences: Breweries, wineries, distilleries, and cideries with on-site retail or tasting rooms
- Liquor sales licences: Grocery stores, convenience stores, and big-box retailers authorized to sell alcohol (expanded under 2024-2025 Ontario reforms)
- Special occasion permit (SOP) holders: Temporary events, festivals, and fundraisers
- By-the-glass licences: Establishments offering by-the-glass wine/beer service
Required Signs for Licensed Establishments
1. Liquor Licence Display
- Requirement: The liquor licence or a copy must be prominently displayed in the licensed premises
- Location: Near the main entrance or at the bar where patrons can see it
- Content: Must show the licence number, licensee name, licensed area, and conditions
- Condition: Must be kept clean, legible, and undamaged
2. Licensed Area Identification
- The boundaries of the licensed area (including any licensed patio) must be clearly identified
- Physical barriers, signage, or markers must delineate where alcohol may be consumed
- Patrons must not carry open alcohol beyond the licensed area
- Patio signs: Licensed patios must be identified with signage and physical boundaries (ropes, fencing, planters)
3. Legal Drinking Age Sign
- "No Service to Persons Under 19 Years of Age" or equivalent wording
- Must be posted at every bar and every entrance to the licensed area
- Must include the reference to valid Ontario photo identification
- Recommended additions: list of accepted IDs (Ontario driver's licence, Ontario Photo Card, Canadian passport, BYID card)
4. Intoxication and Service Refusal Signage
- "It is Against the Law to Serve Alcohol to an Intoxicated Person" — posted behind the bar
- Staff must be trained to recognize intoxication signs — Smart Serve certification is mandatory for all servers
- Smart Serve certification display: While not a posted sign, all serving staff must carry current Smart Serve certification
5. Hours of Service Sign
- Licensed premises must post their hours of alcohol service
- Standard hours: 9:00 AM to 2:00 AM (with last call at 2:00 AM and consumption deadline of 2:45 AM)
- Extended hours: If the establishment has approval for extended hours (e.g., 24-hour hotel lounge), those hours must be posted

6. Pricing and Promotion Signs
- Happy hour restrictions: While Ontario loosened happy hour rules in 2020, promotions must not encourage excessive consumption
- Drink specials: Must be posted with prices and available during stated hours only
- Prohibited promotions: No contests or games that require purchasing alcohol; no unlimited drink offers; no promotions that encourage rapid consumption
- Take-home sales: If the establishment sells sealed alcohol for off-premise consumption, pricing must be posted
7. Capacity Sign
- Under both AGCO requirements and the Ontario Building Code Section 3.1.17, licensed establishments must post maximum occupancy
- Fire Marshal inspectors coordinate with AGCO — overcrowding in licensed establishments is grounds for both fire code and liquor licence enforcement
Liquor Sales Licence Signs (Grocery & Convenience Stores)
The 2024-2025 Ontario expansion of alcohol sales to convenience stores and grocery stores created additional signage requirements under O. Reg. 746/21 (as amended):
- "Licensed to Sell Alcohol" sign at the store entrance
- Age verification sign: "Valid Photo ID Required for Alcohol Purchase — Must Be 19+"
- Hours of sale: Posted at the alcohol display area (typically 7:00 AM to 11:00 PM)
- Alcohol display area: Must be clearly delineated with signage separating alcohol from other products
- Responsible consumption: Signs promoting responsible alcohol use must be displayed near the alcohol area
- No service to minors: At every cash register and self-checkout terminal
Special Occasion Permit (SOP) Signage
- SOP must be displayed at the event entrance
- Licensed area boundaries must be clearly marked with signage and physical barriers
- "No Alcohol Beyond This Point" signs at the boundary of the licensed area
- Age verification signage at every service point
- Server training requirement signage (all servers must be Smart Serve certified)
AGCO Enforcement and Penalties
The AGCO has broad enforcement powers under the Liquor Licence and Control Act, 2019:
- Monetary penalties: Up to $250,000 per offence
- Licence suspension: 1 day to indefinite, depending on severity and history
- Licence revocation: Permanent loss of the liquor licence for serious or repeated violations
- Conditions: AGCO can impose additional conditions on a licence, including mandatory signage enhancements
- Public register: All enforcement actions are published on the AGCO website — visible to the public and potential investors
- Inspector powers: AGCO inspectors can enter licensed premises at any time during operating hours without notice
Common AGCO Signage Violations
- Licence not displayed: The most frequently cited violation — licence must be visible to patrons
- Missing age verification signs: Must be at every entrance to the licensed area and at every bar
- Unclear licensed area boundaries: Especially problematic with patios — patrons must know where alcohol consumption is permitted
- No hours of service posted: Service hours must be posted and strictly observed
- Promotional signs encouraging overconsumption: "All you can drink" or similar promotions are prohibited and posting such signs is an automatic violation
- Missing occupancy sign: Fire code and AGCO both require maximum capacity to be posted
